Our jurisdiction is based on Mitchell v. Forsyth, 472 U.S. 511, 86 L. Ed. 2d 411, 105 S. Ct. 2806 (1985), which permits an immediate appeal under 28 U.S.C. ? 1291 from an order denying a claim of qualified immunity before final judgment. See also Kennedy v.
